Donald Trump: Colorado Court Case?

 


Background

According to the The Colorado Sun, a liberal non-profit filed a lawsuit to remove former President Donald Trump from the presidential primary ballot in 2024. This non-profit believed that Donald Trump's involvement in the January 6th riot should disqualify him from running for president. They used the fourteenth amendment as their reasoning. The Colorado Sun mentions that the fourteenth amendment states a person who took an oath to support the constitution shall not be able to hold office if they have been involved in an insurrection. In summary, Judge Wallace ruled that former President Donald Trump did incite an insurrection but would not remove him from the ballot. 

The Aftermath 

There are similar challenges going on around the country. It will be interesting to see if any of the other challenges have different results. After reading many media sources, most are just reporting the story. The left leaning media sources seem happy that a judge stated that Donald Trump did cause an insurrection.  After reading all of these news stories, I asked myself "Do Trump supporters care". He has been involved in many different court cases and his numbers have not had any significant changes. Instead of looking at his poll numbers when these court cases are happening, people should focus more on what can legally happen to his campaign.

  1. It's difficult to fathom how a Judge can acknowledge that Trump did in fact participate and cause an insurrection but at the same time not remove him from the ballot. This isn't the first case which has refused to remove Trump from the ballot. Dr. DeWitt provided us with a paper he co-wrote that lays out quite profoundly how Trump's words and actions contributed to the insurrection. Thus far, various excuses have been used such as:lack of plaintiff standings to sue, an unclear definition of "insurrection," some claim Congress must pass legislation to enforce the 14th Amendment's disqualification provision, and finally, some judges make the case that In the absence of a criminal conviction, Trump cannot be barred from running for president.
